When real estate is sold, the liability of certified real estate agents, in accordance with Act No. 70/2015 on the Sale of Real Estate and Ships, can also be tested. Certified real estate agents have extensive responsibilities, i.e. concerning sale review and gathering of information.

Through the years, the attorneys at LEX have handled extensive cases for buyers and owners‘associations concerning various defects on both individual and joint property in newly built multi-owner buildings. In these cases, both the liability of sellers in accordance with Act No. 40/2002 has been tested, as well as the liability of construction managers, designers and masters in craftsmanship. In cases of this nature, it can be possible to lodge financial claims in solidum against the abovementioned individuals, as well as claim damages from the mandatory liability insurance of certified real estate agents, construction managers and designers.
