Lára Herborg participated in the Nordic Copyright Symposium 2026
Lára Herborg Ólafsdóttir, Attorney at Law and Partner at LEX, participated in the Nordic Copyright Symposium 2026, held at Harpa in Reykjavík last week.
Lára spoke on the panel “The Output – How to make the infringement assessment of output produced by or with the assistance of artificial intelligence”, which explored the copyright assessment of content generated by or with the assistance of AI.
Her contribution focused on an increasingly important practical question: If AI-generated output is alleged to infringe copyright, how can that infringement actually be proven in court?
While the substantive infringement test may remain technologically neutral, the evidentiary problem is not. Lára addressed, among other things, how to establish a causal link between a protected work and a particular AI output, the evidentiary significance of similarity, prompts, training data and model memorisation, and the practical question of who holds the evidence needed to establish what happened between the original work and the final output.
The panel brought together Nordic copyright scholars and practitioners for an engaging discussion on some of the emerging challenges that generative AI poses for copyright law and its enforcement.
